We do stress the importance of having either an Enduring Power of Attorney (Replaced over recent years by a Lasting Power of Attorney) in place so that relatives or other individuals are able to deal with an individuals financial affairs if they no longer have the mental capacity to do so. In the vast majority of cases it is in fact the Attorney that we deal with in these cases. Not having this legal document in place can result in additional costs, delays and frustration.
